Since 2022, the admission of foreigners to local universities is carried out in a single procedure through https://portal.edu.az which belongs to the Ministry of Education of the Republic of Azerbaijan.

Regulations of education of the citizens of the Republic of Azerbaijan in foreign countries and education of stateless people in the Republic of Azerbaijan.
RULES


1. General provisions

1.1. These regulations have been created according to President Ilham Aliyev’s ordinance number 156 paragraph 2.2 named “About education” dated 5 September 2009 and defines general requirements about the education of the citizens of Azerbaijan Republic at educational institutions of foreign countries, education of foreigners and stateless citizens (from now- foreigners) at educational institutions of Azerbaijan Republic irrespective of ownership and subordination and in all the levels and stages of the education, also at scientific research centers of doctoral level and medical bases on residency level.
1.2. These regulations does not apply to the foreign permanently living in Azerbaijan Republic. These people have the same rights on education with the citizens of Azerbaijan Republic.
1.3. Cases except international contracts that Azerbaijan Republic acceded, the foreigners have no right to study at special formed educational institutions.

2. Education of the citizens of Azerbaijan Republic in foreign countries

2.1. Education of the citizens of Azerbaijan Republic in foreign countries is carried according to the following basis:
2.1.1. According to state programs and international contracts;
2.1.2. On the basis of scholarships (education fee, dormitory, living cost and other expenses) and grants provided by NGOs and charity organizers, legal entities of Azerbaijan Republic, foreign countries and their educational institutions;
2.1.3. On the basis of contacts between the higher educational institutions;
2.1.4. On the basis of quotas allocated by state agencies of foreign countries;
2.1.5. On the basis of contracts that individuals and legal entities of the Republic of Azerbaijan signed with the foreign higher educational institutions.

2.2. The citizens of Azerbaijan Republic are free to choose institutions, specialties (specializations), the level and stage of education that meet the requirements of the country that they are based.

2.3. The educational institutions implement pupil and student exchange with educational institutions of foreign countries according to these Regulations contracts.

2.4. According to paragraph 6.2 of "Regulations on the State Commission for Student Admission of Azerbaijan Republic" approved by President of the Republic of Azerbaijan’s ordinance number 219 dated 6 april 2005, the admission of citizens of the Republic of Azerbaijan to the educational institutions of foreign countries is conducted by State Student Admission of the Republic of Azerbaijan according to the intergovernmental agreement.

2.5. Admission of the citizens of the Republic of Azerbaijan who took their education abroad and who want to continue the next level of education is conducted by Recognition of educational documents and determination of equivalence (nostrification) according to "Regulations of the recognition of higher education specialties of foreign countries and determination of equivalence (nostrification) " approved by the decision number 64 dated 13 May 2003 of Cabinet of Ministers of the Republic of Azerbaijan.

3. Admission of foreigners to the educational institutions of the Republic of Azerbaijan

3.1. Admission of foreigners to educational institutions for the level of education corresponding to their previous education, or for any direction of additional education is conducted according to the following rules:
3.1.1. On a quota basis established according to agreements concluded between the Republic of Azerbaijan and foreign countries in the field of education;
3.1.2. On the basis of international programs where educational institutions participate;
3.1.3. On the basis of contracts concluded between the foreign educational institutions;
3.1.4. On the basis of contracts signed directly with the legal entities;
3.1.5. On the basis of contracts signed directly with the individuals;
3.1.6. On the basis of student admission centralized competition in secondary and high education institutions organized by State Student Admission Commission of Azerbaijan Republic according to paragraphs 6.1 and 6.2 of "Regulations on the State Commission for Student Admission of Azerbaijan" approved by ordinance number 219 dated 6 April 2005 by President of the Republic of Azerbaijan.

3.2. If the foreigners participate in centralized entrance examinations of State Student Admission Commission of Azerbaijan Republic they must submit documents determined by State Student Admission Commission according to paragraph 7.3 of "Regulations of the State Commission for Student Admission of Azerbaijan Republic" approved by ordinance number 219 dated 6 April 2005 by President of the Republic of Azerbaijan.

3.3. Foreigners who want to study through doctorate and dissertation should submit documents according to paragraph 7.3 of “Establishment of doctorate and admission Rules to doctorate” approved by decision number 129 dated July 1 2010 Cabinet of Ministers of Azerbaijan Republic.

3.4. On the base of subparagraphs 3.1.1-3.1.6 of these Rules the foreigners should submit the following documents for studing in Azerbaijan Republic:

3.4.1. An application to the head of the educational institution indicating the chosen specialty, language of education, type of education ( the application may be submitted in electronic form);

3.4.2. Subjects in the previous education level, and document about education indicating marks and accordingly legalized (or apostil) and its (their) notarized copy translated in Azerbaijani language.
3.4.3. Health certificate including certificate about not carrying viruses of AIDS, Hepatitis B and C;
3.4.4. A valid border crossing document;
3.4.5. 6 photos of 3x4 size;
3.4.6. Certificate of the exam in the language of instruction ( if available);
3.4.7. Copies of honorary certificates, diplomas and other documents (if available);

3.5. The foreigners’ appropriate language knowledge and their preparedness on education level is checked by the institution that they have chosen and their admission is formalized if their knowledge is appropriate to the requirements set by the institution.

3.6. If the students want to study in the specialties that the education is in English then they are free from assessment of the language if they have sufficient points on one of the international language examinations ( IELTS 5.0 points, TOEFL 40 points for the bachelor’s degree, IELTS 5.5 POINTS, toefl 50 points for the further education)

3.7. Foreigners of the following categories are free from language assessment when they do not change the language of education:
3.7.1. The ones who studied in the educational institution of Azerbaijan Republic and want to study in the next level or stage of education;
3.7.2. Graduates of previous education level that meet the requirements stipulated by the laws of the host country.

4. Education of foreigners

4.1. Education of foreigners in general and first vocational education is conducted according to appropriate state standards and education programs (curriculum).

4.2. Education of foreigners in high and secondary educational institutions is conducted according to legislation of Azerbaijan Republic, on the basis of credit system, on education programs according to education plans of specialization approved by Azerbaijan Republic Ministry of Education.

4.3. Foreigners studying in the Republic of Azerbaijan have same rights as citizens of Azerbaijan according to 32nd paragraph of Regulations of the Republic of Azerbaijan called “About Education”. Foreigners must follow internal discipline of the educational institution.

4.4. Admission of foreigners to bachelor, master, doctorate and doctorate of scientific organizations is conducted with tuition fee according to contracts that the Republic of Azerbaijan adherents as well as contract that is signed between the foreigner and the institution. This regulation is based on paragraph 2.2 of "Higher education institution Model Regulations" approved by the decision number 9, dated 21 January, 2011 of The Cabinet of Ministers of Azerbaijan Republic. Education of foreigners in compulsory secondary education is conducted free.

4.5. Foreigners that study on the basis of quota pay the amount of tuition fee according to the contracts signed between the foreign countries and Azerbaijan Republic.

4.6. Contracts with foreigners or the legal entities and individuals who pay their tuition fee is signed according to the form indicated in the appendix of these Regulations (with the exception of compulsory secondary education).

4.7. The activities of the educational institution mentioned in the subparagraphs 3.1.2, 3.1.3 and 3.1.4 is conducted by informing the Ministry of Education of Azerbaijan Republic (if another stat body conducts the founder functions, this state body should also be informed as well)

4.8. The educational institution presents reports about the foreign students to the Ministry of Education of the Republic of Azerbaijan and The State Statistics Committee once a year.

4.9. A state document on education is given to foreigners who have completed educational institution.

4.10. Transformation of foreign students from one educational program or from one educational institution into another, their dismissal, their taking an academic vacation or reinstatement are regulated according to paragraph 3.8 of "Higher education institution Model Regulations" approved by the decision number 9 , dated 21 January 2011 of the Cabinet of Ministers of the Republic of Azerbaijan and paragraph 3.9 of "Exemplary Charter of secondary special education institution" approved by the decision number 7 dated 14 January 2011 of the Ministry of Education of the Republic of Azerbaijan.

4.11. Information about foreign students and graduates of high and secondary education institutions is being included into “Student-graduate” state electronic information system.

4.12. Information about the dismissal of the foreigner from from the educational institution in the Republic of Azerbaijan should be given to the Ministry of Education of the Republic of Azerbaijan and State Migration Service of the Republic of Azerbaijan within 3 (three) working days by the educational institution.

CONTRACT
On getting paid education between *the title of the
education institution* and a foreign student

*The title of the education institution*, hereinafter referred to as “the education institution”, on the one hand, ___________________, hereinafter referred to as “the foreign student”, on the other hand, have concluded the Contract on following content:

1. Subject matter of the Contract


The education institution undertakes to teach, on paid basis, the foreign student on the specialty of _______________ at to the _____________ education level based on educational programs that meet state standards of the Republic of Azerbaijan, and the foreign student undertakes to study on the specialty chosen according to the state standards, to pay the tuition fee in the amount of _______ Azerbaijani manat for each academic year at the education institution.

2. Responsibilities of the Parties


2.1. The education institution:
2.1.1. issues a decree on the admission of the foreign student to the education institution after he/she transfers at least 50% of his/her annual tuition fee to the education institution prior to the beginning of the academic year;
2.1.2. provides specialist training in accordance with the state educational standards and competences defined by the education programs of various specialties;
2.1.3. provides an opportunity for the foreign student to use the rights and guarantees established for the citizens of the Republic of Azerbaijan studying on a paid basis;
2.1.4. introduces the foreign student to the educational process and internal discipline, and explains his/her rights and responsibilities;
2.1.5. gives a document of state example (diploma) to the foreign student after he/she successfully completes the education.

2.2. The foreign student:

2.2.1. collects the required credits by studying under the curriculum on the specialty chosen;
2.2.2. pays the tuition fee on an annual basis until ___________;
2.2.3. complies with the internal rules of the education institution;
2.2.4. within 90 (ninety) days from the date of the formalization of admission to education institutions of the Azerbaijan Republic, submits a copy of the document confirming his/her residence in the territory of the Azerbaijan Republic to the education institution.

3. Additional terms and conditions of the Contract

3.1. The education institution is entitled to terminate this Contract concluded with a student in the following cases:
3.1.1. in case the foreign student commits acts that are prohibited by the internal disciplinary rules;
3.1.2. in case the tuition fee is not paid within the period specified in the Contract;
3.1.3. in case of a court decision on imprisonment or exclusion of the foreign student out of the borders of the Republic of Azerbaijan;
3.1.4. in case the student fails to submit a copy of the document confirming their residence in the territory of the Republic of Azerbaijan to the education institution within the period specified in sub-clause 2.2.4 of this Contract.

3.2. The paid tuition fee is non-refundable if the foreign student is unable or unwilling to continue his/her education for any reason, and is expelled from the education institution on the grounds mentioned above.

3.3. Disputes arising between the parties as a result of breach of the terms and conditions of the contract are considered at the courts of the Republic of Azerbaijan.

3.4. This Contract was compiled in 2 identical copies in Azerbaijani, one copy is kept in the personal folder of the foreign student at the education institution, and the other one is kept by the foreign student himself/herself.
